Judge OKs new well for AVCC (May 20, 2010)

A judge has denied a request for an injunction that would have blocked the town of Apple Valley from drilling a new well at the Apple Valley Country Club. In his ruling, Judge Gilbert Ochoa wrote that granting the injunction would cause greater harm to the town than the denial would cause to the High Desert Community Foundation.

The ruling is part of the town’s ongoing lawsuit over water rights to the Apple Valley Country Club. Apple Valley and the foundation both claim water rights to the country club. The town sued HDCF in 2008, asking the nonprofit to give up a deed to water rights for the golf course. The foundation filed a countersuit, with that case expected to go to trial in December.
